On April 1, 2024, Germany marked a historic milestone in its cannabis policy. With the new legislation allowing the private use of cannabis under certain conditions, Germany joins the ranks of European countries taking a more progressive approach to cannabis.
What is now permitted? From this date, people over the age of 18 may possess up to 25 grams of cannabis for personal use and grow up to three plants at home. In addition, it is permitted to store up to 50 grams of dried cannabis at home. These changes are aimed at curbing the black market and reducing the police and judicial burden in relation to minor cannabis offenses.
Are there any restrictions? Yes, there are. The consumption of cannabis near schools, kindergartens, public playgrounds and sports facilities as well as in pedestrian zones in city centers between 7 a.m. and 8 p.m. remains prohibited. In addition, possession and consumption remains illegal for people under the age of 18.
Cannabis social clubs Another interesting aspect of the new regulation is the introduction of so-called "cannabis social clubs". These may have up to 500 members, who must be resident in Germany for at least six months. The clubs will be allowed to collectively grow and distribute cannabis to their members from July 1st, with a daily limit of 25 grams and a monthly limit of 50 grams per member.
A divided response The new legislation was not introduced without controversy. While supporters celebrate the move as an end to the criminalization of cannabis users, critics, including medical associations and health experts, warn of the potential risks, especially for young people. The concern is that the use of cannabis, especially at a young age, can impair the development of the central nervous system and increase the risk of psychological damage.
A look into the future While Germany is breaking new ground with this legislation, the debate surrounding the legalization of cannabis and its sale in stores remains open. The current regulation could be seen as the first step towards a more comprehensive legalization and regulation of cannabis in Germany.
